| W.O.Stinson & Son Ltd. offers
to supply and you agree to purchase your entire requirements
of furnace oil at the address shown below, until 30 days written
notice to terminate is given by you or W.O.Stinson & Son
Ltd.
W.O.Stinson & Son Ltd. shall endeavour
to maintain an adequate reserve level of fuel oil in you tank(s)
at all times. You shall notify W.O.Stinson & Son Ltd. immediately
of an abnormally low reserve and advise us promptly in writing
of any changes to the buiding, storage tanks or fuel oil requirements.
We reserve the right to inspect you oil tank(s) at any time
and to refuse delivery if they do no meet applicatble Codes
or any Federal, Provinvial or Municipal bylaws or statutes.
The price of fuel sold hereunder shall be W.O.Stinson
& Son Ltd.'s prevailling tank wagon price at the time and
place of delivery. Payment shall be made within the time specified
on your monthly statement or on other terms as may be agreed
upon in writing. You shall pay a service charge on overdue accounts
as set out in W.O.Stinson & Son Ltd. statements form time
to time. If you fail to pay for any fuel oil provided hereunder
within the period agreed for payment W.O.Stinson & Son Ltd.
shall not be obliged to supply fuel while such default continues.
W.O.Stinson & Son Ltd. shall not be liable
for failure to supply fuel hereunder if prevented by an act
of God, strike, flood, fire, embargo, boycott, insurrection,
unavoidable accident, shortage of labour or fuel oil or any
other cause beyond it's reasonable control.
W.O.Stinson & Son Ltd. shall not be liable
for any injury or damage to any person or property resulting
from the existence and operation or non operation of any oil
burning installation at your premises. We shall not be liable
for any damage caused by furnace failure while your property
is vacant not for any special or consequential damage resulting
from failure to perform any obligations under this agreement. |
